Transport Insurance

Marine cargo (transport) insurance provides comprehensive risk management for exporters, importers, carriers, freight forwarders and all other participants in the logistics chain, protecting goods against damage, destruction and loss throughout the entire journey — from loading, through carriage by all modes of transport (road, rail, sea, inland waterway, air and multimodal), to unloading, transhipment and temporary storage.

Real-world examples

Traffic accident, fire, explosion, natural perils (storm, flood), theft and robbery, rough handling in transit, overturning and dropping of a shipment, damage to temperature-sensitive goods (e.g. a break in the cold chain) and theft or pilferage during storage and transhipment.

Carrier's liability (CMR)

The limitation of liability under Article 23 of the CMR (as revised by the 2006 Protocol) is a maximum of 8.33 SDR per kilogram of gross weight; the limit is calculated as 8.33 × the SDR/EUR rate × kilograms (gross). Cover also includes cabotage, the carriage of dangerous goods (ADR), the carriage of perishable goods (ATP) and the services of sub-carriers.

Claim notification deadlines

Visible damage must be reported immediately, supported by a report signed by the consignee and the driver; non-apparent (concealed) damage — inland carriage under the CMR within 7 days, domestic carriage under the Law on Obligations within 8 days, sea carriage within 3 days of discharge, and air carriage within 14 days of receipt.

Key notes

Financial (purely pecuniary) losses under a cargo policy are generally excluded, save for specifically listed charges (general average, salvage, disposal, replacement delivery); the insured is obliged to take all reasonable measures to avert or minimise the loss and to preserve the right of recourse (subrogation) against the responsible party.
